Terms and Conditions
Welcome to Final Stage. (“Final Stage”, “we”, “us” or “our”). By using our website, www.thefinalstage.com.au, or any other related services (collectively, the “Platform”), you agree to be bound by these Terms of Service and our Privacy Policy, which can be found at thefinalstage/privacy-policy (collectively, the “Terms”).
Please read the Terms carefully before using the Platform. We provide the Platform to you subject to the Terms. By using or accessing the Platform in any way, viewing or browsing the Platform, or adding your own content to the Platform, you are agreeing to be bound by the Terms. If you do not agree to all the Terms, then you may not access the Platform or use any services.
Purchases
We may provide the ability to purchase certain products or services through the Platform. All descriptions, images, references, features, content, specifications, products, and prices of products and services described or depicted on the Platform are subject to change at any time without notice. Certain weights, measures, and similar descriptions are approximate and are provided for convenience purposes only. We make all reasonable efforts to accurately display the attributes of our products, including the applicable colours; however, the actual colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.
The prices applicable to certain products and services are as set forth on the Platform and are subject to change without notice. We reserve the right to discontinue any product at any time. All products or services are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to reject any order you place with us, and/or to limit quantities on any order, without giving any reason.
If a product or service you have ordered is out of stock, we may contact you by email or telephone and ask you if you wish to: (i) wait until the item is in stock; (ii) exchange the item for another item; or (iii) cancel your order and receive a refund.
Shipping
We will arrange for shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges specified during the ordering process. Title and risk of loss or damage pass to you upon our transfer of the products to the carrier. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.
Returns and Refunds
Our online store offers a 30-day warranty on all products sold. If a product is found to be defective within 30 days of purchase, we will replace the item, exchange it for another or refund the purchase price, at our discretion. We ask that customers contact us within 30 days of purchase to notify us of any defects, we are not responsible for damage caused by improper use, misuse, accidental damage, or natural disasters. Products returned after the 30-day warranty period will not be eligible for replacement or refund. We do not accept returns of opened or used products, we do not accept responsibility for any additional costs incurred due to a defective product. Shipping and handling fees are non-refundable.
We reserve the right to modify our warranty policy at any time without prior notice.
Payment
We accept major credit and debit cards. By submitting your order, you represent and warrant that you are authorized to use the designated card and authorize us to charge your order (including taxes, shipping, handling and any other amounts described on the Platform) to that card. If the card cannot be verified, is invalid, or is not otherwise acceptable, your order may be suspended or cancelled automatically.
Email & SMS Messages
Final Stage mobile message service (the "Service") is operated by Final Stage (“Final Stage”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Final Stage SMS/Email messaging service, you agree to receive recurring SMS & Email messages from and on behalf of Final Stage through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Final Stage. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Final Stage mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

The Platform and all information, content, materials, products (including software) and other services included on or otherwise made available to you through the Platform are provided by us on an “as is” and “as available” basis, unless otherwise specified in writing. We make no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, materials, products (including software) or other services included on or otherwise made available to you through the Platform, unless otherwise specified in writing. You expressly agree that your use of the Platform is at your sole risk.
Limitation of Liability
In no event shall we, our subsidiaries, affiliates, officers, directors, employees, agents, partners, or suppliers be liable for any indirect, consequential, special, incidental, or punitive damages resulting from your access to, use of, inability to use, or purchase of products or services from the Platform, or damages for lost profits, loss of revenue, or loss of data, however caused, whether based on contract, tort, or any other legal theory, and even if we have been advised of the possibility of such damages.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Queensland, Australia., You agree that any dispute or legal proceeding in relation to the Website and/or our Products shall be brought exclusively in the courts of Queensland, Australia.
Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Platform.
